By accessing or using Spill ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Spill is a platform that allows users to send messages and donations to creators. Users must sign in to send messages, with optional monetary donations ("boosts") processed through Stripe.

3. User Accounts

Account Creation: You may create an account using Google Sign-In. You are responsible for maintaining the security of your account.

Username: You must choose a unique username. Usernames cannot be changed after creation. You are responsible for all activity under your username.

Account Termination: You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these terms.

4. User Conduct

You agree not to:

• Send harassing, threatening, or abusive messages
• Impersonate others or provide false information
• Use the Service for illegal purposes
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Send spam or unsolicited messages
• Violate any applicable laws or regulations

5. Payments and Donations

Payment Processing: All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service.

Donations: Donations ("boosts") are voluntary payments to creators. Donations are non-refundable except as required by law or at our sole discretion.

Platform Fees: Spill charges a platform fee on donations. The fee structure is displayed at the time of payment.

Creator Payments: Creators who connect a Stripe account receive a portion of donations after platform and processing fees. Payment processing times are subject to Stripe's policies.

6. Content and Intellectual Property

Your Content: You retain ownership of messages you send. By sending a message, you grant Spill a license to display and store that content as necessary to provide the Service.

Platform Content: The Service, including its design, features, and functionality, is owned by Spill and protected by copyright and other intellectual property laws.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Disclaimers

Service "As Is": The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

No Guarantees: We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any loss or damage resulting from your use of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Spill shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Spill, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these terms.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes by posting the updated terms on this page. Your continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Spill operates, without regard to its conflict of law provisions.
